Lara Kroeker Interactive provides managed WordPress hosting and technical maintenance, powered by Kinsta on Google Cloud Platform infrastructure. Services support the performance, security and stability of your website and are provided on an “as is” basis.
This agreement is between Lara Kroeker Interactive (“LKI”) and you (“the Client”).
The agreement
1. Websites Covered
This agreement covers the website or websites listed on the signup form below. Website means one WordPress installation.
A covered website may serve more than one domain. Additional domains pointing at a covered website are included at no extra charge. A separate WordPress installation is a separate website, whether or not it shares a domain name with a covered site.
Websites are added or removed only in writing. Where a website is added, the annual fee is adjusted from the next renewal date and the addition is priced separately until then. Where a website is removed, it remains covered to the end of the paid period unless both parties agree otherwise.
Where a covered website is archived or taken offline at the Client’s request, LKI will supply a final backup and the website comes off this agreement at the next renewal.
2. What’s Included
- Hosting on Kinsta, including server infrastructure and global CDN (Cloudflare)
- SSL certificate, installed and kept current
- Automated daily backups, retained according to the hosting plan
- Uptime monitoring
- Filtering of malicious traffic before it reaches your site
- WordPress core, plugin and theme updates, performed on a regular basis
- PHP kept on a current, supported version
- General technical maintenance relating to the hosting environment
3. What’s Not Included
- Content updates, including text, images or page changes
- Design work or new feature development
- SEO, marketing or content services
- Configuration of third-party software or external services
- Recovery work arising from changes made by the Client or by third parties
These are available as separate services and quoted individually.
4. Your Plan and Fees
Your plan and annual fee are recorded on the signup form and form part of this agreement.
Fees are billed annually in advance unless otherwise agreed in writing. You will receive an annual invoice summarising your services, including hosting, domains where applicable, and any associated renewals.
5. Fee Reviews
Fees may be reviewed annually. LKI will give no less than 30 days written notice of any change, which takes effect from your next renewal date. If you do not wish to continue at the revised fee, you may terminate under section 10 before that renewal date.
6. Payment
Invoices are due on the date stated. Where an invoice remains unpaid 30 days past its due date, LKI may suspend maintenance services after giving written notice. Hosting will not be suspended without at least 14 days further notice.
7. Domains
Where a domain has been purchased and is managed by LKI, it may be included as part of this service, as recorded on the signup form. Otherwise the Client is solely responsible for domain registration, renewal and management.
LKI is not responsible for a domain lapsing where the Client holds the registration.
8. Access and Licences
LKI retains administrative access to the website for the duration of this agreement in order to provide the services described.
Where LKI supplies commercial plugin or theme licences as part of the service, those licences are held by LKI and do not transfer to the Client on termination. The Client is responsible for obtaining their own licences from that point.
9. Important Limitations
Client websites rely on third-party software, including plugins, themes and external services. LKI does not guarantee the compatibility, performance or continued availability of any third-party tool. Updates to WordPress, plugins, themes or external platforms may result in errors, conflicts or loss of functionality.
Hosting is provided without guarantee of uninterrupted or error-free operation. While Kinsta provides high-performance, secure infrastructure, LKI is not responsible for outages, interruptions or issues originating from third-party systems or providers.
Regular backups are maintained as part of this service. LKI does not guarantee that backups will be error-free or fully restorable in all situations, and is not liable for data loss.
Any work required to resolve issues caused by third-party changes, incompatibilities or failures will be assessed separately and may be billed as additional services.
10. Term and Termination
This agreement continues until terminated by either party with 30 days written notice.
Annual fees are non-refundable. Where you terminate mid-term, services continue to the end of the paid period and no refund of the balance is due. Where LKI terminates other than for non-payment, the unused portion of the annual fee will be refunded pro rata.
On termination, the Client is responsible for migrating the website. LKI will provide a final full backup on request within 30 days of termination. Beyond that, LKI is not responsible for ongoing hosting, data retention or migration unless separately agreed.
11. Liability
To the fullest extent permitted by law, LKI shall not be liable for any direct, indirect, incidental or consequential damages, including but not limited to data loss, service interruptions, lost revenue or third-party failures.
Where liability cannot be excluded, it is limited to the fees paid by the Client in the twelve months preceding the claim.
12. Acceptance
By submitting this form, or by engaging in services, the Client acknowledges and agrees to these terms.
